Temporary visa — granted on lodgement. Remain in Australia lawfully while the permanent visa processes.
Permanent visa — typically granted ~2 years after 820 lodgement. No additional charge.
Must be married to or in a de facto relationship (usually 12+ months) with an Australian citizen, PR, or eligible NZ citizen. Same-sex couples are eligible.
You must be within Australia at the time of application and usually hold a substantive visa.
Must be 18 years or older to apply.
Standard health and character requirements apply. Exceptions may still allow grant.
Any debts to the Australian government must be repaid or subject to a repayment agreement.
Sponsors may be restricted if they have sponsored partners previously — 5-year and lifetime limits apply, with compassionate exceptions.
Most minor children can be included in the application. Children who turn 18 during processing may still be eligible if certain criteria are met.
Children not included in the original 820 application can be added later via the Subclass 445 Dependent Child visa.
Important: The ability to add dependants closes once the Subclass 801 is granted.
